What your notice must say

Federal law sets out what a takedown notice has to contain. The list is in 17 U.S.C. 512(c)(3). A notice that leaves out one of these six parts may not count as a valid notice, and we may have to come back and ask you for the missing piece.

  1. Your signature, typed or handwritten. If you are not the owner, say who you act for.
  2. The work you say was copied. If more than one work is involved, list each of them.
  3. The material you want taken down, with a link or a clear description of where it sits on our site or in our app.
  4. How to reach you: a mailing address, a phone number, and an email address.
  5. A statement that you believe in good faith that this use is not allowed by the owner, by the owner's agent, or by law.
  6. A statement that what you wrote is accurate, and, under penalty of perjury, that you are the owner or are allowed to act for the owner.

Do not send a notice about material you do not own the rights to. If you knowingly say something is infringing when it is not, you can be made to pay the costs and legal fees that your claim caused.

What we do when a valid notice arrives

We remove the material, or we block access to it, and we do that promptly. We tell the member who posted it what came down and why, and we send them a copy of the notice. We keep a record of every notice we act on.

If we removed your material by mistake

You can send us a counter notice. Send it to the same agent above. It needs these six parts:

  1. Your signature, typed or handwritten.
  2. The material that was taken down, and where it was before we removed it.
  3. A statement under penalty of perjury that you believe it was taken down by mistake, or because it was mixed up with something else.
  4. Your name, mailing address, and phone number.
  5. A statement that you accept the authority of the federal court for the area where you live. If you live outside the United States, name the area where our company can be found.
  6. A statement that you will accept legal papers from the person who sent the notice, or from that person's agent.

We pass your counter notice to the person who complained. If they do not tell us they have gone to court within 10 business days, we may put your material back. In practice that happens between 10 and 14 business days after we forward the counter notice.

Repeat infringers

We count the valid notices we act on against the account that posted the material. An account that draws repeated valid notices is closed, and we do not reopen it. We also close accounts that we find are being used to post other people's work.
